Agent Partner & Referral Fee Terms
These terms govern participation as a listing agent partner on VA Home Connect, a real estate referral platform operated by Shawn Keehan, a Virginia-licensed real estate salesperson affiliated with Samson Properties. VA Home Connect introduces home sellers and buyers to licensed Virginia real estate agents and is not a party to any real estate transaction, listing agreement, or brokerage relationship you form with a client.
Tiered referral fee schedule
When a seller introduced to you through VA Home Connect closes with your representation, a referral fee is owed for the introduction, payable at settlement. Because referral compensation may only be paid through licensed brokers, the fee is paid broker-to-broker to Samson Properties. The fee is calculated on the gross listing-side commission you receive at closing:
Partner obligations
By submitting a proposal, you agree that the referral fee above becomes payable at settlement upon closing of the referenced transaction. The fee is paid broker-to-broker: your brokerage remits it to Samson Properties within ten (10) business days of closing.
You agree to execute a standard Virginia Association of REALTORS® Exclusive Right to Sell Listing Agreement with the seller through your own brokerage after acceptance. Your brokerage relationship with the seller is entirely your own — VA Home Connect's only interest in the transaction is the referral fee for the introduction, which is paid through Samson Properties in accordance with Virginia license law.
12-month protection period
The referral fee is owed on any sale or lease of the introduced homeowner's property that closes within twelve (12) months of the date their contact details were released to you through VA Home Connect — whether the transaction is completed by you, by another licensee at your brokerage, or through a re-listing, and whether or not it is recorded on this platform. Contact releases are time-stamped and logged.
Outcome reporting
You agree to report the status of every accepted proposal in your Deals & Fees tab — under contract, closed (with final sale price and settlement date), or not sold — within five (5) business days of the event. Failure to report does not waive the referral fee.
How to pay the referral fee
When you report a closing, VA Home Connect generates an invoice showing the gross listing-side commission, the applicable tier, and the amount due, along with a signed Samson Properties Referral Agreement and a completed IRS Form W-9 for your brokerage's accounting. The fee is paid broker-to-broker by check payable to Samson Companies, LLC (dba Samson Properties), attn: Shawn Keehan — VA Home Connect referral, 14291 Park Meadow Drive, Suite 500, Chantilly, VA 20151. Please enclose details of the sale with the check. Payment is due within ten (10) business days of settlement. Unpaid fees result in removal from the platform and may be referred for collection.
Referrals are sent through Samson Referral LLC, a Virginia Real Estate Board licensed referral firm (license #0226007538), so referral compensation flows broker-to-broker as Virginia license law requires.
Late fees & collection costs
Invoices not paid within ten (10) business days of settlement accrue interest at one and a half percent (1.5%) per month on the unpaid balance until paid in full. In any action to collect unpaid fees, the agent agrees to pay VA Home Connect's reasonable attorney's fees and collection costs, whether or not suit is filed.
Verification & audit rights
Upon request, the agent agrees to provide the Closing Disclosure, HUD-1 settlement statement, or equivalent settlement document to verify the fee calculation. The agent consents to VA Home Connect verifying transaction status and sale price through MLS records and public real estate records for any property introduced through this platform.
Lead confidentiality
Seller contact information unlocked upon proposal acceptance is provided solely for the purpose of representing that seller. It may not be resold, redistributed, or used for unrelated marketing.
Termination
Either party may terminate participation at any time with written notice. Referral fees on transactions already in progress remain due at closing.
Governing law & venue
These terms are governed by the laws of the Commonwealth of Virginia. Any dispute arising under these terms shall be resolved in the state courts located in Virginia Beach, Virginia.
